Anyone representing a client with foreign investments in Russia - particularly in the mineral and natural resources sectors - should be aware of the new restrictions implemented last July. In summary, the new restrictions apply to investments in the oil, gas and hard mineral fields, some power transmission companies, along with telecoms, media, aviation and other industries.

We've blogged about the English-Russian and Russian-English on-site legal interpretation and the on-site Russian legal translation services in Russian litigation and arbitration. Russia recently reformed its rules and regulations for forming a Limited Liability Company. The reforms are applicable to both domestic and foreign companies. As the vast majority of companies formed in Russia operate as LLCs, these reforms have far-reaching effects. For those representing Russian companies currently set up as a LLC, the company's corporate documentation must be amended to conform with the new rules no later than January 1, 2010. All amendments must contain a foreign language translation.

Language translation issues often come up in the context of foreign language words in trademarks. In a case involving vodka, the TTAB clarified its definition of the Doctrine of Equivalents by refusing to register the mark Moskovskaya. The central issue was the definition of "the ordinary American purchaser" in reference to the applied for mark.

To get an international patent filed in accordance with the PCT (Patent Cooperation Treaty) procedures, the applicant must submit a translated copy of the patent contents to the World Intellectual Property Organization (WIPO) within 18 months in one of the official languages recognized under the treaty.
