Legal Language Translation Services and International Legal Malpractice

We've blogged about multilingual professional translations of keywords during e-Discovery and the attorneys' professional responsibility in responsibility in responding to a multilingual discovery demand. We also blogged about certified document translations and the risk of using online legal forms in foreign jurisdictions. Over the past 30 years, according to the ABA, the largest category of malpractice claims went from being in connection to missed deadlines to being in relation to a 'failure to know or apply the law'. With more and more attorneys finding themselves dealing with foreign laws, this trend is, unfortunately, only likely to continue. As the ABA concludes, 'as the volume of law to know expands (for example, by conducting business abroad), one's ability to ascertain and properly apply it decreases'.

Legal Document Translation & Interpretation Services and International Law in the Private Sector

Not all international law is public. When business occurs across borders, there is little room for such international legal bodies as the United Nations or the International Criminal Court. Instead, another body of international law is developing, dealing with how to apply foreign laws in international business disputes.

Multilingual E-Discovery Translation Services and Victor Stanley II

When dealing with e-discovery in a foreign language, a professional foreign language translation needs to be used even before an attorney will be able to judge the evidence's probative value. In the 2010 case Victor Stanley, Inc. v. Creative Pipe, Inc., 269 F. R.D. 497 (D. Md. Sept. 9, 2010), the court ruled that "the duty to preserve is an obligation owed to the court, not to the adverse party". Specifically, the ruling stated:

Multilingual Translator Services and the Trend among Expatriates

We've blogged about multilingual document translation services and US taxes, certified corporate translations and double taxation, as well as global translation and interpretation services for expatriates. A recent report authored by Andrew Mitchel shows an increasing trend in the number of individuals renouncing their US citizenship or simply expatriating from the US. The cause for this trend is diverse and can include anything from international job assignments, relationships or searching for more business-friendly environments. Regardless of the why, the end result will ultimately be an increase in international legal issues - particularly in the fields of tax, trust and estates, property and family law- requiring services of professional legal translators and court interpreters.

Professional Technical Language Document Translations of Spanish and Portuguese Environmental Regulations

We've blogged about professional document translation services used during climate change litigation and the role of technical translations in registering a foreign aircraft in the U.S. Operating a US branch or subsidiary overseas is becoming more and more complex - mainly because the body of rules and regulations regarding the environment are becoming more tailored to specific jurisdictions. Many environmental regulations contain highly technical engineering and natural science terminology requiring services of professional Spanish-English and Portuguese-English technical translators and interpreters. Gone are the days when all litigation occurred at the public/international law level. Today, many international corporate cases are being adjudicated in international tribunals, meaning that companies now need to learn a whole new legal system, which are often tailored to a specific issue like the environment.

Website Translation Services, Social Media and the Discovery Process

Professional foreign language document translations and language interpreting services play an important role during discovery stage of litigation. We've discussed certified document translation services of the evidence found in social media.

There is no doubt that an attorney wishing to obtain evidence located on a private social media platform has the right to seek such evidence via the formal discovery process. In fact, numerous courts have ruled that such a practice is allowed so long as the discovery demand is made in good faith and is in line with the Federal Rules of Civil Procedure (and related laws and rules).
